Form 8886 is not simply an informational form, it actively alerts the IRS when a taxpayer is involved in a "reportable transaction" (often known as a "listed transaction"). When filed, it does the following:
This number is a temporary IRS procedure, in effect since October 1, 2020 "until further notice," and it is not a general submission line, it is only for faxing the separate OTSA copy of a reportable transaction's initial year Form 8886. You must still attach the original Form 8886 to your income tax return, that filing is never done by fax. If you already mailed or faxed your OTSA copy for a transaction's initial year, do not fax a second copy in a later year. Send only one exact copy per fax, up to a maximum of 100 pages, with a cover sheet listing the subject, your name, title, phone number, address, the taxpayer's name, the date, and the total page count (no EIN or SSN on the cover sheet). The IRS does not provide a fax confirmation or receipt, so keep your own transmission log.
If this is the first year you're disclosing a given reportable transaction, the IRS requires a separate copy for its Office of Tax Shelter Analysis in addition to the Form 8886 you attach to your tax return. Under Section 6707A, the penalty for failing to disclose a reportable transaction is 75% of the tax benefit the transaction would provide, with a minimum of $5,000 for an individual and $10,000 for anyone else. The annual maximum is $10,000 for an individual and $50,000 for others on most reportable transactions, but it rises to $100,000 for an individual and $200,000 for others if the undisclosed transaction is a listed transaction specifically.
A listed transaction is one the IRS has specifically identified by name as a tax avoidance transaction, the highest-scrutiny category. Form 8886 also covers four other reportable categories: confidential transactions, transactions with contractual protection, loss transactions above set dollar thresholds, and transactions of interest, where the IRS suspects abuse but hasn't formally listed the transaction yet.
